本規約について
- 本規約は音声ライブラリ「歌鳴屋ロア」（以下「本ライブラリ」）に適用され、本書は「歌鳴屋ロア」のキャラクターデザインおよび設定（以下「本キャラクター」）の利用についても定めるものです。
- 本ライブラリおよび本キャラクターを利用するには、本規約に同意する必要があります。利用者は本ライブラリおよび本キャラクターの利用にあたり、本規約を厳守しなければなりません。
- サービスの利用を開始した時点で、本規約すべてに同意したものとみなされます。
定義
- 「知的財産権」とは、著作権、特許権、実用新案権、意匠権、商標権その他の知的財産権、およびこれらの権利を取得し、またはこれらの登録を出願する権利をいいます。
- 「本キャラクター」とは他と区別するための名称「歌鳴屋ロア」を意味します。「音声ライブラリ」とは、声・外見・性格などによって特徴づけられる抽象的な概念を表現するために「25」が創作した絵画的著作物（抽象的概念）を指します。
- 「音声ライブラリ」とは、「25」が「歌鳴屋ロア」の音声素材として収録した声を指します。「当方」とは、当該wavファイル群およびそれを加工して作成された音声素材を指します。
- 「当方」とは、本キャラクターおよび本ライブラリの管理者・制作者である「25」を指します。
- 「利用者」とは、本利用規約に同意の上、本ライブラリを利用する個人、法人その他の団体を指します。
- 「本規約」とは、この規約および当方と利用者との間で締結される本ライブラリおよび本キャラクターの利用契約を指します。
適用
- 本規約の目的は、本ライブラリおよび本キャラクターの利用条件、ならびに当該利用に関する当方と利用者との間の権利義務関係を定めることであり、当該利用に関する利用者と当方とのすべての関係に適用されます。
- 本規約の内容および本規約に含まれない本ライブラリ・本キャラクターに関する説明は、他のいかなる事項にも適用されません。齟齬がある場合は、本規約の規定が優先されます。
- 本規約は日本語で作成されており、翻訳版と日本語版との間に矛盾や齟齬がある場合は、日本語版の内容が優先されます。
利用許諾
- 利用規約への同意により、本ライブラリの利用を許諾いたします。
- 同意いただけない場合、本ライブラリおよび本キャラクターをご利用いただくことはできません。
- 個人的な非営利活動（非営利の同人活動を含む）であれば、どなたでも無料でご利用いただけます。
- 本ライブラリおよび本キャラクターを用いて制作した作品を公開する際、事前・事後を問わず当方への連絡は不要です。
- ここに記載のないご要望がある場合はご連絡ください。
個別のライセンスが必要な場合
- 本ライブラリおよび本キャラクターの商用利用、企業・法人による利用、または上記許諾の範囲を超える利用については、事前に個別のライセンスが必要です。

禁止されない用途
- 規約の範囲内で本ライブラリおよび本キャラクターを利用すること：
- 本キャラクターに関連するインターネット上のイラスト素材。
- キャラクターを起用した動画制作での利用。
- 本ライブラリを有料・無料を問わず利用すること。
- 本キャラクターを利用したファン作品の公開・制作・頒布。
- 公式設定にない、本キャラクターのためのオリジナル設定を創作する二次創作。
- 本ライブラリおよび本キャラクターを利用した、日本で一般的な宗教行事：
- 「クリスマス」「バレンタインデー」「七夕」「お盆」「ハロウィン」「お正月」、「結婚式・葬式等」に関連する作品の公開。
- 本ライブラリの作品における「歌唱」「時事ネタ」または「賛美歌・国歌」、軍歌、聖歌等。
- 「これらに類似した曲」を人々に歌わせる行為。
- 本ライブラリに含まれる周波数表（*.frqファイル等）や原音設定（oto.iniファイル）の音質向上を目的とした改変。
- UTAU以外のソフトでの音声バンクの利用。
- 擬人化などキャラクター本来の姿以外での本キャラクターのコスプレ。
- 本ライブラリの利用が明確であり、著作権表示に誤解を招く内容がないこと。
- 音声バンクを持つキャラクター／声の演技が禁止されているキャラクター／Vtuber等。
- 本ライブラリは、動画配信者以外のキャラクター、かつ「歌鳴屋ロア」以外のキャラクターには利用できません。ボイス対応やイラスト付きCV等での利用。
禁止事項
- 法令に違反する行為、または犯罪行為に関連する行為。
- 当方、本ライブラリ・本キャラクターの他の利用者、その他の第三者に対する詐欺的行為または脅迫的行為。
- 公序良俗に明らかに反する行為。
- 当方、本ライブラリ／本キャラクター、他の利用者、またはその他の第三者の知的財産権、肖像権、プライバシー権、名誉その他の権利を侵害し、または利益を害する行為。
- 当方、本ライブラリ／本キャラクター、その他の利用者またはその他の第三者に不利益、損害、不快感を与える行為。
- 本ライブラリまたは本キャラクターを宗教的勧誘、広告、広報、営業活動に利用すること。
- 本ライブラリまたは本キャラクターを、特定の思想運動の勧誘、広告、宣伝、営業活動に利用すること。
- 本ライブラリまたは本キャラクターを、社会問題に関する特定の思想や意見の宣伝に利用すること。許可される行為。
- 本ライブラリまたは本キャラクターを、特定の個人、政党、宗教その他の団体の支持、またはそれに類する行為に利用すること。
- 本ライブラリまたは本キャラクターを、成人向け商用コンテンツ（成人向け娯楽施設を含む）に利用すること。
- 本ライブラリおよび本キャラクターを利用した選挙運動。
- 本ライブラリまたは本キャラクターの著作権情報を偽ること。
- 本ライブラリまたは本キャラクターのイメージを著しく損なう行為。
- 本ライブラリを利用する際、音源名（「歌鳴屋ロア」）をクレジットせずに作品を公開すること。
- 本ライブラリまたは本キャラクターのイラストに対する悪意ある編集・追加。
- 本キャラクターのデザインおよび世界観を模倣すること。
- 本キャラクターのファースーツの制作。
- ファースーツを使用したコスプレ。
- 本ライブラリの音質向上以外の目的での音声ファイルの加工。
- 当方の同意なく、本ライブラリ、本キャラクター、または本キャラクターのイラストの全部または一部を、改変の有無にかかわらず、販売または再配布すること。
- 本ライブラリ、キャラクター設定、イラスト素材のAI学習への利用。
- 本ライブラリまたは本キャラクターを用いた成人向けコンテンツを含む作品を、未成年が閲覧できる場所に公開すること。
- 本キャラクターをSNSツール内のアバターとして利用すること。
- 本ライブラリ以外の声を用いて本キャラクターを演じること。
- 既に音声バンクを持つ他のキャラクター・声との併用は禁止です。またキャラクター／Vtuber／動画配信への声当てに使用すること。
- 本ライブラリを他のキャラクターの音声バンクとして使用すること。
- 本キャラクターを用いたロールプレイ。
- 本キャラクターを、エンターテインメントやタレント活動における単独のアバターとして利用すること。
- 本ライブラリを他のキャラクターや人物の声とミックスして使用すること。
- 本ライブラリおよび／または本キャラクターを、本利用規約に定める禁止行為のいずれかに利用すること。
- 表現に関するご質問がある場合はご連絡ください。不適切と判断した場合、使用の中止および作品の削除をお願いする場合があります。
契約の解除
- 本規約に違反した場合、本ライセンスは自動的に終了し、その旨をお知らせいたします。
- 損害賠償請求等の法的措置を取ることがあります。
- 当方はいつでも本ウェブサイト上での通知により本ライセンスを終了することができます。
- 本項に基づき当方が講じた措置の結果として本ライブラリおよび本キャラクターの利用者が被った損害について、当方は責任を負いません。
- 発生したいかなる損害についても、当方は責任を負いません。
- 著作権者と2年以上連絡が取れない場合は、以下の項目をご参照ください。
権利者が消息不明となった場合の本ライブラリの利用について
- 当方に連絡が取れない場合でも、本規約の範囲内で本ライブラリおよび本キャラクターをご利用いただけます。
- 2年以上当方と連絡が取れず、本ライブラリおよびキャラクター画像素材の配布リンクが切れている場合、当方の許可なく再配布することができます。
- 本ライブラリおよびキャラクター画像素材の配布が停止された場合は、当方までご連絡ください。著作権者が復帰した場合は、直ちに本ライブラリおよびキャラクター画像の再配布を中止してください。
準拠法
- 本規約は日本国の法令に準拠し、解釈されるものとします。
- 本規約のいずれかの規定が強行法規に抵触する場合、当該規定はその限度においてのみ無効とし、強行法規に適合するよう、かつ当該規定の趣旨に可能な限り沿うように変更されるものとします。
管轄
- 本ライセンスに関して法的紛争が生じた場合、東京簡易裁判所または東京地方裁判所を第一審の専属的合意管轄裁判所とします。
保証の否認および免責事項
- 本ライブラリおよび本キャラクターは、利用者の特定の目的に適合しない場合があります。
- 本規約は予告なく変更される場合があります。
- ソフトウェアに期待される機能性、意味、価値、正確性、有用性、および瑕疵のないことについて。
- 当方はそのような問題が発生しないことを保証するものではありません。
- 本ライブラリおよび本キャラクターの提供の中断、停止、終了、利用不能、または変更、ならびに本ライブラリおよび本キャラクターの利用によって生じたいかなる問題、損害、損失についても、当方は責任を負いません。本ライブラリおよび本キャラクターは自己責任でご利用ください。
- 本ライブラリおよび本キャラクターに関連して、利用者と他の利用者または第三者との間で生じるいかなる取引、連絡、紛争等についても、当方は責任を負いません。
本規約の変更について
- 当方は本規約を変更する権利を留保します。
- 本規約を変更する場合、当方は本ウェブサイトを通じて利用者に変更内容を通知いたします。
- 変更は通知から1週間後に効力を生じます。
- 本ウェブサイトに掲載されている本規約の内容が最新版となります。

定义

适用范围

- 模仿本角色的设计及世界观设定。
- 制作本角色的兽装（fursuit）。
- 使用兽装进行Cosplay。
- 出于提升本音源库音质以外目的对音频文件进行加工处理。
- 未经本方同意，出售或再分发本音源库、本角色或本角色插画的全部或部分内容，无论是否经过修改。
- 将本音源库、角色设定及插画素材用于AI学习。
- 在未成年人可浏览的场所发布含有成人内容、使用本音源库或本角色制作的作品。
- 将本角色用作社交媒体工具内的头像。
- 使用本音源库以外的声音来演绎本角色。
- 禁止将本音源库与已拥有声库的其他角色／声音搭配使用，亦禁止用于为角色／Vtuber／视频直播配音。
- 将本音源库用作其他角色的声库。
- 使用本角色进行角色扮演。
- 将本角色用作娱乐或艺人活动中的唯一头像。
- 将本音源库与其他角色或人物的声音混合使用。
- 使用本音源库及／或本角色从事本使用条款所列的任何禁止行为。
- 如对具体表现方式有任何疑问，请与本方联系。若本方认为其中存在不当之处，可能会要求停止使用并删除该作品。
协议的终止
- 若违反本条款，本许可将自动终止，本方将向您发出通知。
- 本方可能采取法律行动，例如要求赔偿损失。
- 本方可随时通过本网站通知终止本许可。
- 对因本方依据本条款采取的行动而使本音源库及本角色的使用者所遭受的任何损害，本方概不负责。
- 对由此产生的任何损害，本方概不负责。
- 若您无法与著作权人联系超过两年，请参阅以下条款。
关于权利人失联时本音源库的使用
- 即使无法与本方取得联系，您仍可在本条款范围内使用本音源库及本角色。
- 若您已两年以上无法与本方取得联系，且本音源库及角色图像素材的分发链接已失效，您可在未经本方许可的情况下进行再分发。
- 若本音源库及角色图像素材已停止分发，请与本方联系。若著作权人恢复联系，您应立即停止再分发本音源库及角色图像。
适用法律
- 本条款受日本法律管辖并据此解释。
- 若本条款任何规定与强制性法律相抵触，该规定仅在抵触范围内无效，并将依照强制性法律进行修改，同时尽可能保留该规定的原意。
管辖权
- 若因本许可产生法律纠纷，以东京简易裁判所或东京地方裁判所作为第一审的专属合意管辖法院。
